These Terms of Use (“Terms”) govern your use of txserverfinder.com (the “Site”), operated by Chesapeake Commerce LLC, a Maryland limited liability company, 9 Ramsdell Ct, Gaithersburg, MD 20878 (“we”, “us”). By using the Site you agree to these Terms. If you buy a paid listing or job post, these Terms and our Refund & Cancellation Policy apply to that purchase.

1. What the Site is

1.1 The Site is an independent directory of process servers certified by the Texas Judicial Branch Certification Commission (“JBCC”). Listings are compiled from the JBCC’s public licensee list and refreshed about weekly.

1.2 We are not affiliated with, endorsed by, or acting for the JBCC, the State of Texas, any court, or any listed process server. We do not serve process, give legal advice, or act as an agent for anyone.

2. Information only — verify before relying

2.1 Guides and listings are general information, not legal advice. Court rules and local requirements change; consult the current Texas Rules of Civil Procedure, the court clerk, or a lawyer.

2.2 A “Verified certified” badge means only that the person appeared as Active on the JBCC public list on the check date shown. Status can change after that date. Before hiring or relying on a server’s certification, confirm it on the JBCC’s official search.

2.3 We do not guarantee that any listing is accurate, complete, or current. We do not rate, endorse, or vouch for any listed server, and we do not publish reviews.

3. Hiring a process server

Any engagement is solely between you and the server. We are not a party to it and are not responsible for a server’s work, fees, conduct, or the validity of any service of process.

4. Listings, claims, corrections and removal

4.1 Basic listings are free. Every server shown as Active on the JBCC list may be listed automatically. We show the information described in our Privacy Policy.

4.2 Claims. A certified server may claim a listing to correct it or add business details. We verify claims by confirming with the email address the JBCC publishes for that certification number, or by other reasonable proof such as the JBCC certification card. We may decline a claim we cannot verify.

4.3 Removal. A listed server may ask us to remove their listing at any time using the removal form. We honor verified requests within 10 business days and keep only the certification number on a suppression list so the listing is not re-added.

4.4 We may edit, suspend, or remove any listing or content at our discretion, including when a certification is no longer Active.

5. Paid services

5.1 Featured listings (one county or statewide) are monthly subscriptions billed in advance through our payment processor, Stripe. They renew automatically each month until cancelled. Featured placement is advertising and is always labeled “Featured”. It never changes certification information.

5.2 Eligibility. Only servers shown as Active on the JBCC list may buy or keep featured placement. If a featured server’s certification is no longer Active at a weekly refresh, the placement is paused. If it is not restored before the next renewal date, we cancel the subscription.

5.3 Job posts are one-time purchases displayed for 30 days. They must describe genuine work related to process serving and comply with law. We may decline or remove posts that do not. A job post we do not publish is refunded in full; a published job post is non-refundable.

5.4 Prices are shown on the Site and may change. Changes apply from your next billing period after notice to you. Prices exclude any taxes that apply.

5.5 Cancellation and refunds. You can cancel a subscription anytime in our Stripe billing portal (https://billing.stripe.com/p/login/00w4gBeiq19y16Ue0Sasg00); cancellation takes effect at the end of the current paid month. Refunds are governed by the Refund & Cancellation Policy.

5.7 Featured slots and fulfillment. At most 3 servers are featured on any county page, allocated first come, first served. A purchased placement goes live within 1 business day after we verify the certification.

5.6 You authorize us, through Stripe, to charge your payment method for the plan you choose. We do not receive or store full card numbers.

You are responsible for information you submit (claims, corrections, job posts). It must be accurate and lawful. You grant us a non-exclusive, royalty-free license to display it on the Site for the purpose you submitted it.

8. Intellectual property

The Site’s design, text, and compilation are ours. Public records remain public. Third-party sources are credited on our Data & methodology page and are used under their own terms.

9. Third-party sites

Links to the JBCC, courts, payment pages, and other sites are provided for convenience. We are not responsible for their content or practices.

10. Disclaimers

THE SITE AND ALL LISTINGS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. THIS INCLUDES DAMAGES FROM RELYING ON A LISTING OR FROM THE ACTS OF ANY PROCESS SERVER. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND (B) US $100.

12. Indemnity

If you buy a paid service or submit content, you agree to indemnify us against third-party claims arising from your content or your breach of these Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Before filing any claim, please contact us so we can try to resolve it informally within 30 days. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Texas, and you and we consent to their jurisdiction.

14. Changes and termination

We may update these Terms by posting a new version with a new effective date. Material changes to paid services take effect from your next billing period. We may suspend access for breach of these Terms.
